As writers ourselves, we understand how important it is for authors to protect their intellectual property. Our terms and conditions are designed to protect your rights, so you can use The Motley Writers Guild without reservations. Use of The Motley Writers Guild critique and beta reading services constitutes acknowledgement and acceptance of the following terms and conditions:
1. Ownership, Copyright and Confidentiality
The Motley Writers Guild is committed to providing a secure, reliable service. We take protection of intellectual copyright very seriously. All Customers will retain all copyrights, ownership and control over their work. The Motley Writers Guild will not publish or otherwise repurpose the Customer’s work in any way unless specified and given permission by the Customer associated with said work.
Work submitted to us will be treated as private and confidential.
The Motley Writers Guild shall keep all materials containing confidential information in a safe and secure place, until such time as the Customer requests its destruction or deletion. To request deletion of your work, please Contact Us.
2. Quality and Standards of Service
The Motley Writers Guild agrees to read work submitted per the guild’s guidelines and to provide a comprehensive critique. If, for any reason, the Customer is dissatisfied with The Motley Writers Guild critique / beta reading service, a refund will only be issued if our work does not meet the terms of our service as outlined or if unforeseen circumstances result in The Motley Writers Guild’s inability to complete the said service.
3. Submission Content
To The Motley Writers Guild plagiarism and breach of copyright are serious offenses, and should submitted work show evidence or be suspected of either copyright infringement or plagiarism, editing will not proceed. Work will immediately be halted on the project and the Customer will be notified of such.
The Motley Writers Guild reserves the right to refuse to proofread, edit, or create any document that advocates or incites violence, hatred, or discrimination, as well as any document that is obscene or pornographic, or in contravention of national and international laws.
The information contained in Customer documents critiqued or beta read by The Motley Writers Guild may include opinions or views that are not those of The Motley Writers Guild or any person associated with The Motley Writers Guild. The Motley Writers Guild is not responsible or liable in relation to the use of any information contained in Customer documents including misleading or defamatory statements, or the infringement of third party copyright.
4. Client/Submission Information
To participate in The Motley Writers Guild critique/beta reading service, it is the Customer’s responsibility to provide true and accurate information requested, including but limited to; their name, address, phone number, email address, and payment details etc. needed to complete the service and receive payment once rendered. Failure to provide correct and accurate information can result in a refusal to provide said service. The Customer assumes all responsibility for any problems, errors, and issues, as well as legal liability, resulting from falsified information. All information submitted by the Customer is treated as confidential and secure.
The Customer is responsible for providing accurate and descriptive requirements to The Motley Writers Guild at the time of submitting a job, or prior to a quote being issued. These requirements form the statement of work. Failure by the Customer to provide correct and accurate information in the statement of work may result in the cancellation of a transaction. Where a transaction is cancelled due to a breach of these terms and conditions, a refund will be offered to the Customer of all money paid less any associated cost incurred by The Motley Writers Guild, including bank/transfer fees and editor costs. The Customer assumes all responsibility for any problems, errors, and issues, as well as legal liability resulting from an incorrect statement of work.
5. Refusal or denial of service
The Motley Writers Guild reserves the right to deny or refuse service to any Customer or prospective Customer for any reason and without explanation.
6. Financial Fraud or Theft
The Motley Writers Guild is not liable for the fraudulent use of any credit card or other payment method that may be used to purchase its services.
7. Liability
Ultimate responsibility for use of any documents critiqued or beta read by The Motley Writers Guild on behalf of the Customer remains with the Customer. Use of The Motley Writers Guild critique / beta reading service does not guarantee selection by an agent/publisher, success in the market, or the future publication of the Customer’s work. The Motley Writers Guild shall not be liable to the Customer in connection with the use of this website for any indirect, economic or consequential loss whatsoever, for any loss of business, loss of contracts, loss of profits, loss of use, loss of goodwill or loss of reputation resulting from the Customer’s use or inability to use this website.
8. Indemnification
The Customer agrees to indemnify and hold The Motley Writers Guild and its associated members harmless from any claim or demand, including reasonable fees and costs for the service of an attorney, or as may be made by any third party due to or arising from use of the site or service, or violation of the Terms and Conditions by the Customer, or infringement of any intellectual property or other right of any person or entity by the Customer.
9. Technical Disclaimer
The Motley Writers Guild is not liable or responsible for service delays resulting from unforeseen circumstances, such as technical problems, including server or connection issues that are beyond our control. We will make every effort to meet deadlines and communicate with Customers in the case of technical problems.
The Motley Writers Guild is not liable or responsible for any damage to computer hardware or software arising from the distribution of a computer virus through the use of the The Motley Writers Guild website or system.
10. Payment/Quotes
The Motley Writers Guild and its members reserve the right to choose the payment service utilized in service transactions and to change this at anytime as determined by its members. Customers are responsible for any fees associated with or required to process payment through said service and no amount shall be subtracted from the payment owed The Motley Writers Guild.
The Customer understands that quotes are based on information provided and if circumstances change (ie: due date, word count) the actual billing amount may vary from what was initially quoted. A deposit totaling 25% of the initial quote is due prior to work start. By submitting your work to The Motley Writers Guild and paying 25% of the initial quote you are agreeing to pay the fee associated with the service once completed (and any subsequent fees needed to complete the transaction, minus deposit). And to remit payment via The Motley Writers Guild member’s chosen payment service, PayPal, Wise, Square, etc., upon receipt of said bill.
